History repeats...Anwar & Sodomy Case

This is not a legal post......but rather a food for thought. I remember well when I was in 2nd and 3rd year in 1997 and 1998, the same story happen in Malaysia....the same havoc the same political uncertainty and the same feeling of frustration....now in 2008 it happens again....'the sodomy story'.....can't they be more creative in shaping our political landscape? Man will do all things necessary to get what they want.....

Email Question: Tenancy, how to chase out 'illegal tenant'

Salam KI, I'm (name deleted), cool blog you have!... I have a problem regarding my condo which I authorised a real estate agent to find tenant and do all the necessary rental arrangement. The agent finally found a potential tenant, an immigrant from Pakistan. He was let in the house after handed in post-dated checque valued 3 months rental payment. (2 + 1 basis). On the date of the checque, the tenant told the agent not to cash the cheque as there is no money in the bank!! The agreement however has not been signed by the tenant., I wrote a letter to him to ask him leave the house on a certain date, at the same time to TNB and condo management to cut the electricity and water supply to the house on the mentioned date. A week went by, he still does not want to move out from my house and refused to pay by end of this month, total of 4 months rental payment. (2 + 1 basis plus rental for July). We dont want them anymore as we afraid the same thing will reoccur in the future. The agent h

SPAM law in Malaysia

Image
hi, I was asked by one of public member and if I may the credit should go to Mr. Mohamad S.M who asked me the question. I find it is rather an interesting topic so that I am trying to put my personal comment on the issue. The comment here, is however may not be so detail due to limited time of research. In Malaysia, the law governing SPAM is still (in my humble opinion) not yet comprehensive or to the extent having been really 'operative', when we talk about spamming activities, we are often advice to 'handle' the situation personally (in pain words) or practice a good 'spam management'. the job to restrain spamming as at now is more or less left to the Internet Service Providers (ISP). Maybe because the level of urgency in taking this issue seriously is not that high yet in Malaysia or may be, as what been told by the Malaysian Communications and Multimedia Commission (MCMC ) the need to upgrade the existing law would only effective if such law is similar or st

Dewan Rakyat

Image
I am honestly quite disappointed that the media (government) at last minute decision cancel the life telecast of today's (Monday 23rd June, 2008) 'Dewan Rakyat' sitting..... perhaps because of the unprecedented motion try to be brought up by SAPP... :) That goes transparency! Anyway, I am not so eager to know whether or not the motion can go through neither supporting any political party. But rather I am very much want to see this 'new' motion in Malaysia that never been done before. This is 'a Malaysian Book of Records'. May be I could write something regarding the matter after viewing the telecast. Well, if I have enough time and information regarding the motion, I will try to put in this blog my legal view. Petrol Subsidy

Friends, this is my first topic and I think I would like to share with all. As we all already know the Malaysian government has taken an initiative to ease the burden of its citizens (after the 'surprise' petrol and diesel hike) by giving all 'qualified' motor-vehicle owner a sum of RM150 or RM625 per year and other road tax discount. Frankly, I do not wish to discuss on this decision neither am I going to talk about it 'acceptance' from the public point of view. But rather I wish to point out my concern about the problem that we may hear at least few months from now (if my prediction is correct); dispute regarding the claiming of the subsidy money. I have heard one person come to me complaining that he has bought a vehicle from another person or an agent and that till date the seller or the agent has failed to properly transfer the ownership to his name, so he fails to claim the subsidy money. Well, without blaming him for his careless or failure to deal proper
